Terms and Conditions of Sale

These Terms and Conditions of Sale govern the purchase of artwork, including commissioned portraits and original paintings, by Daniela Sirigu. By accepting these terms and conditions, the buyer agrees to abide by the provisions listed herein.

Art. 1 – Identification data of the seller.

Art. 2 – Subject matter of the contract

  1. These conditions govern the sale of original paintings and commissioned portraits made by Daniela Sirigu, through direct contact or e-commerce platform.
  2. Commissioned portraits are made on the basis of photographs provided by the purchaser, who assumes full responsibility for the legality and use of such images.
  3. Each work sold comes with a certificate of authenticity, attesting to the originality of the work.
  4. The contract of sale is concluded when the buyer makes payment and receives order confirmation from Daniela Sirigu or through the e-commerce platform.

Art. 3 – Method of purchase and payment

  1. Works can be purchased through:
    • Direct contact with Daniela Sirigu via email.
    • E-commerce platform available on the website.
  2. For e-commerce purchases, payment can be made by credit card, bank transfer or other payment methods available on the site.
  3. Payment is immediate for e-commerce purchases. Order confirmation is sent via email once payment is completed.
  4. For commissioned portraits, a detailed quote will be provided after receipt of photographs and required specifications. Work will begin only after payment of a 50% deposit, with final balance before delivery.

Article 4 – Prices and taxes

  1. All prices shown on the website and in quotes are in euros (€) and, unless otherwise specified, include applicable taxes.
  2. Shipping costs, if not included in the price of the work, will be communicated at the time of order confirmation and indicated separately.

Article 5 – Shipping and delivery

  1. Purchased works will be shipped to the address indicated by the buyer by courier, using professional protective packaging.
  2. The buyer is required to accept the package subject to verification, i.e., must sign the delivery receipt indicating “subject to” if there is visible damage to the packaging.
  3. Daniela Sirigu is not liable for damage to the works that is not immediately reported to the courier at the time of delivery, in the manner provided for accepting the package with reservation.
  4. In case of obvious damage, the buyer must notify both the courier and Daniela Sirigu immediately no later than 24 hours after receipt of the goods.
  5. Shipping and insurance charges for goods, if applicable, will be specified at the time of purchase.

Art. 6 – Right of withdrawal

  1. The buyer has the right to withdraw from the purchase of original paintings within 14 days of receipt, without having to give any reason, provided the work is returned in the same condition in which it was delivered.
  2. The right of withdrawal does not apply to custom works or commissioned portraits, as these are products created at the specific request of the buyer.
  3. To exercise the right of withdrawal, the buyer must send written notice to Daniela Sirigu within 14 days from the date of receipt of the work.
  4. The refund will only cover the price of the purchased product, excluding shipping and return costs, which will remain the responsibility of the buyer.
  5. Before proceeding with the refund, Daniela Sirigu will verify the integrity of the returned work. If the work has damage or defects not attributable to transportation, the amount will not be refunded.
  6. Refunds will be made within 14 days of receipt of the returned work, upon confirmation of its integrity.

Article 7 – Warranty

  1. Daniela Sirigu guarantees that all works sold are original and handmade.
  2. Works are accompanied by a certificate of authenticity (see Art. 10).
  3. Any defects or damage, not attributable to transportation, must be reported within 7 days of receipt of the work. After this deadline, the work will be considered accepted by the buyer without reservation.
  4. The warranty does not apply to damage caused by misuse or improper storage of the work.

Article 8 – Limitations of Liability

  1. Daniela Sirigu will not be held liable for indirect, incidental, or consequential damages resulting from the use of the purchased works, nor for any delays in delivery attributable to third parties (e.g., couriers).
  2. Daniela Sirigu ‘s liability is limited to the purchase price of the work.
  3. Failure to report any damage caused in transit within 24 hours of delivery releases Daniela Sirigu from any liability.

Article 9 – Resolution of disputes

  1. In the event of disputes relating to the interpretation, validity or performance of this contract, the parties agree to attempt an amicable resolution, through direct negotiation.
  2. If no agreement is reached, disputes will be under the exclusive jurisdiction of the Court of Prato, Italy.
  3. The buyer has the right to use alternative dispute resolution (ADR) procedures in accordance with applicable regulations.

Art. 10 – Certificate of Authenticity

  1. Every artwork sold by Daniela Sirigu is accompanied by a certificate of authenticity, attesting to its provenance and originality.
  2. The certificate of authenticity guarantees that the work was created by the artist and is a unique and inseparable document from the work itself.
  3. If the work is returned due to withdrawal, the certificate of authenticity must be returned with the work. Failure to return the certificate will result in the cancellation of the right to a refund.
